Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 14 - RISKS ASSOCIATED WITH USE OF PRODUCTS AND SERVICES

This Website provides different products imported from abroad or procured domestically that are curated to be part of the Gold'n'Silk subscription box or in our online store. Gold’n’Silk is a distributor and idea generator. Gold’n’Silk is not a product testing organization and Gold’n’Silk does not manufacture the Products. Gold’n’Silk obtains the Products from suppliers and manufacturers that Gold’n’Silk believes are reputable and reliable, however, Gold’n’Silk is not in a position to test every Product and/or to assess the safety of every suggestion that Gold’n’Silk makes for User consideration.

Gold’n’Silk is not a medical organization and cannot – and does not – provide you with medical advice or clearance to use certain Products or engage in any activities. Nothing contained in this Website should be construed as medical or other professional advice. Any suggestions by Gold’n’Silk as to use of Products or activities should not be interpreted as a substitute for physician consultation, and product safety assessment. You must use good sense and personal judgment about your use of the Products and the activities in which You engage.

Like many things in life, having fun often entails taking risks. Whether one is jumping out of planes, rock climbing, playing football or swimming alone without a life guard, risk is an unavoidable element of the activity. For some, the very fact that an activity is risky is an important ingredient for why the activity is fun. It can be very dangerous or very safe to ski down a black diamond slope at the ski resort, depending on the skier’s ability, equipment, avalanche conditions and weather. Using Gold'n'Silk Products and getting inspired by any suggestions by Gold'n'Silk or other Users as to how the Products can be used or activities, adventures, travels to make is a bit like skiing – it can be very safe or very dangerous in our opinion depending on the user’s experience, personality and the conditions surrounding the use of the Products or experience one is seeking.

If there is a risk of injury from use of the Products, replication of any depictions on the Website of use of the Products, or attempts to copy or follow any suggestions on the Website (from Gold'n'Silk or other Users). If there are scenarios where the risk could include catastrophic injury or death. As set forth below, it’s up to the User to evaluate and address any risks associated with use of the Products or any suggested uses of the Products as Gold'n'Silk is not a product testing or safety organization.

Some of our products will be sold in the original packaging received from the manufacturer or supplier, and some of our products will be sold in our packaging. Not all manufacturers or suppliers provide thoughtful warnings, instructions and disclaimers. However, some manufacturers and suppliers do provide thoughtful warnings, instructions and disclaimers. Our prices would need to be increased materially beyond what we believe to be market pricing if we were to attempt to assess and potentially re-write warnings, instructions and disclaimers for each product in our inventory. Therefore, we need to leave the job to You to independently assess any manufacturer/supplier supplied warnings, instructions and disclaimers as we make no representations or warranties as to the suitability of such warnings, instructions and disclaimers. 

As an illustration, it is common place for some products to be marked by the manufacturer/supplier as “novelty only.” Some products are intended merely as novelty products, yet other products are clearly not intended as novelties. We’re not in a position to have each supplier and/or manufacturer/supplier remove “novelty only” marking where we think the marking inappropriate or inaccurate. Therefore, You must assess whether or not the product is really a novelty only product or is actually intended for a particular use. You agree that You will read and assess all warnings, instructions and disclaimers and that You will apply your independent judgment as to the safety of the Products You purchase, and that You will consult us if You have any uncertainty or You do not understand any warnings, instructions or disclaimers.

What is your allergen policy?

Our subscription boxes will contain beauty products such as creams, perfumes and others as well as snack and treats. Some products are manufactured in the same facility or shared equipment with your allergen. Please use your judgement when consuming or using these products. Please read the label carefully as manufacturing practices can change at any time. There are also products that may contain coconut in the Nut-free box. We cannot be held responsible for the accuracy of ingredient or nutritional information provided or be held liable for any adverse reactions caused by the products we sell. YOU HEREBY AGREE TO HOLD HARMLESS GOLD'N'SILK AND ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, VENDORS, DISTRIBUTORS, LICENSEES AND CONTRACTORS FROM ANY LIABILITY ARISING FROM INACCURATE, INCOMPLETE OR MISSING WARNINGS, INSTRUCTIONS AND DISCLAIMERS PROVIDED BY OUR SUPPLIERS OR MANUFACTURERS OF THE PRODUCTS WE INCLUDE IN OUR SUBSCRIPTION BOXES AND STORE.

SECTION 15 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless GoldnSilk and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 16 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

This Agreement, and any disputes arising from, relating to, or touching upon the Agreement and/or the subject-matter hereof, shall be construed under and governed by the law of the State of Massachusetts. All contracts resulting from or relating to this Website shall be deemed entered into in the State of Massachusetts.

In Gold'n'Silk's discretion, Gold'n'Silk may insist that any dispute arising out of or related to any product or service or this Website be arbitrated in Boston or metro-Boston, Massachusetts pursuant to the commercial rules of the American Arbitration Association; provided, however, that any equitable remedies available via the state and federal courts of Massachusetts may remain in effect after Gold'n'Silk elects arbitration pending resolution of the arbitration.

SECTION 21 - VENUE; PERSONAL JURISDICTION; SERVICE OF PROCESS

Any action at law, suit in equity, or other judicial proceeding concerning, relating to, or touching upon in any way this Agreement or the subject-matter hereof, shall be brought or commenced, if at all, only in the courts of Massachusetts. By accessing and using the Website, You (and any person or entity on whose behalf You act) hereby submit to personal jurisdiction in Massachusetts in any action by or against You and waive and release now and forever any defense to that assertion of jurisdiction that might otherwise exist. You (and any person or entity on whose behalf You act) agree to accept service of process for any claim arising out of or related to these Terms via either email (at the email address You provide us) or a national private carrier (e.g., FedX, UPS), and You hereby waive personal service.
